Terms and Conditions of Service
By enlisting Unloading.ca 's services, you hereby agree to the terms and conditions outlined below:
The Service Provider

The Client
- Any individual, business or organization that is currently or has the intention of enlisting Unloading.ca 's services.
The Service
- Unloading.ca 's services consist of unloading (de-stuffing) the goods from shipping containers received at the client's facility, and performing work associated with the removal, organization and storage of said goods onto pallets and/or into said facility. The services also include cleaning and clearing the inside of the shipping container of any dust or debris, within reason.
- Services may also include any other tasks agreed upon by Unloading.ca and the client.
- Areas of service are limited to the Metro Vancouver Area (unless otherwise agreed upon).
- Unloading.ca 's regular work hours are 8am to 5pm (PST), Monday to Friday (excluding statutory holidays).
Service Request
- A service request is defined as a communicated notice from the client to Unloading.ca for the purpose of enlisting Unloading.ca to carry out their services.
- The client must specify the desired day, time, location and details of the service (including, but not limited to: size of the the shipping container, number of SKU's, total number of items, total weight of the container payload and description of the contents to be unloaded) in the service request.
- Any and all service requests made by the client must be emailed to operations@unloading.ca.
- Service requests made over the phone, sent by text, sent to an email other than operations@unloading.ca or by any other means may or may not be considered.
- Unloading.ca 's availability for service cannot be guaranteed if the client makes a service request for same day service, or after 4pm (PST) for next day service.
Cancellation or Rescheduling
- Any and all cancellation or rescheduling notices must be emailed to operations@unloading.ca.
Client Responsibilities
- The shipping container, whether on a container chassis or otherwise, must be adequately stable. It must not move or rock while conducting the services.
- The client’s facility must be in proper working condition (i.e. level floor, clean air, pest-free, etc.) and be sufficiently clear of dust, debris and any other hazards that could pose a health and safety risk to Unloading.ca 's staff.
- The client must provide at their facility all necessary materials and equipment to properly complete the services, including but not limited to: pallets, stretch wrap, a pallet jack, a power jack, a forklift and/or anything else to successfully and safely complete the services.
- The client must ensure that their facility has enough available space to store the contents of their shipping container.
- Unloading.ca reserves the right to terminate the services if these conditions are not met before or throughout the services.
Terms of Service
- While conducting the services, Unloading.ca and their staff will remain courteous and professional with the client and their staff.
- Unloading.ca and their staff will perform their duties to the best of their abilities in an efficient and safe manner, all while handling the clients goods with care as to not damage them.
- At any point while conducting the services, if Unloading.ca or their staff deem the facility or the work environment unsafe or unsuitable, Unloading.ca reserves the right to end the services at that point in time.
- Except as otherwise agreed upon, and unless proper precautions are taken beforehand, Unloading.ca will refuse to perform the services if the contents of the client’s shipping container could pose a health or safety risk to Unloading.ca 's staff (e.g. corrosive chemicals, explosives, hazardous gases, sharp objects, etc.).
- Unloading.ca will not be responsible for accidental damages to goods due to an unstable product arrangement.
- Unloading.ca will not be responsible for any fines or fees associated with the condition, transport or deadlines of the shipping container.
Pricing and Costs
- Costs for services will be determined by Unloading.ca and shared with the client prior to conducting the services.
- Prior to any change in costs, the client will be notified.
- Invoices will be sent at the end of the week, on a weekly basis.
- Invoices equal to or under $1000.00 are due within 15 days of the invoice date.
- Invoices over $1000.00 are due within 30 days of the invoice date.
- A monthly late fee of 2% of the total amount due will be charged on overdue payments.
- Pricing and estimates do not include GST.
- All monetary amounts are in CAD (Canadian Dollars).
Additional Fees
- Same day service requests, and service request made after 4pm (PST) for next day service may be subjected to a $60.00 "rush fee" at Unloading.ca 's discretion.
- Same day cancellation or rescheduling notices, and cancellation or rescheduling notices sent after 4pm (PST) for next day scheduled service may be subjected to a $60.00 "cancellation/rescheduling fee" at Unloading.ca 's discretion.
- An “Overtime Fee” may be charged if services are requested outside of Unloading.ca 's regular work hours at Unloading.ca 's discretion.
- A waiting fee of $30.00 per hour (minimum 1 hour) per staff present may apply if services cannot be commenced within 30 minutes of the scheduled service time at Unloading.ca 's discretion.
- Additional fees may apply for additional complexity or unsafe product arrangement at Unloading.ca 's discretion.
- Failure to provide the required space, supplies and/or equipment to successfully complete the service may result in additional fees at Unloading.ca 's discretion.
- A "travel fee" will be charged for any requests for service outside of the Metro Vancouver Area, based on the distance.
Confidentiality
- Unloading.ca agrees that they will not disclose, divulge, reveal, report or use, for any purpose, any confidential information which Unloading.ca has obtained, except as authorized by the client or as required by law.
Insurance and Liability
- Unloading.ca will not be liable or responsible for any loss, theft, or damage to the property of the client, and will not be liable for injury or damage to persons or property while conducting the services.
- Unloading.ca must ensure that their staff are covered by WorkSafeBC insurance.
- Unloading.ca's WorkSafeBC account number is : 201043808.
- Both Unloading.ca and the client must possess valid Commercial General Liability Insurance and provide proof of their insurance policy to the each other upon request.
Governing Law
- This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia.
Severability
- In the event that any of the provisions aforementioned are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts withheld.
